These Terms of Service ("Terms") govern your use of the CYBIONYX InMotion application (the "App") and the website inmotion.cybionyx.space (together, the "Service"), provided by Kibioniks LLP, trading as Cybionyx ("we", "us", "our"). By installing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. To use the Service you must meet the minimum age required by the law of your country (in the EU/EEA, generally between 13 and 16) and be able to enter into a binding contract.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own personal or internal business use, subject to these Terms and to the Meta Horizon Store terms. We retain all rights, title, and interest in and to the App.

You are solely responsible for the content you choose to stream from your own computer and for ensuring you have the right to view and stream it.
The App works by capturing your screen and sending synthetic mouse and keyboard input to your PC. Some third-party software — in particular online games with anti-cheat systems — may detect this and restrict, suspend, or ban your account. You are solely responsible for ensuring your use of the App complies with the terms of any other software you use it with, and we are not liable for any action taken against your accounts by third parties.
CYBIONYX InMotion streams your PC's screen to your Meta Quest headset over your local network or a USB cable. The Service requires your own compatible PC and headset and your own network. Performance depends on your hardware and network conditions, which are outside our control. All streaming happens directly between your own devices; we do not operate servers that relay or store your content.
On Windows, the App may install a low-level input driver to send keyboard and mouse input to your PC. This component requires administrator permission to install and may require a system restart. You consent to its installation, and we are not responsible for conflicts with security, antivirus, or anti-cheat software, or for other effects on your system resulting from its use.
We may modify, suspend, or discontinue the Service, or any part or feature of it, at any time, with or without notice, and are not liable for any such change. We have no obligation to provide support, maintenance, updates, or new versions of the App.
The App consists of a Meta Quest component, distributed through the Meta Horizon Store and running on Meta hardware, and a PC component for Windows and macOS, available from our website. Your use of the Quest component is also subject to Meta's terms and policies. If anything in these Terms conflicts with the Meta Horizon Store terms for the Quest component, the Meta Horizon Store terms prevail to the extent of the conflict. We are not responsible for the products, services, or policies of Meta or any other third party.
Your use of the App is also governed by our Privacy Policy. The App processes data only locally on your devices and does not collect personal data.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by applicable law, Cybionyx and Kibioniks LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of, or inability to use, the Service. To the extent liability cannot be excluded, our total aggregate liability shall not exceed the amount, if any, you paid for the App.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for our intentional acts or gross negligence, or for any other liability that cannot be excluded or limited under the mandatory consumer-protection law of your country of residence. Where liability may lawfully be limited, the limitations in this section apply only to the extent that law permits.
You agree to indemnify and hold Kibioniks LLP and its officers, employees, and agents harmless from any claims, losses, liabilities, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, the content you stream, or your violation of these Terms or of any law or third-party rights.
Virtual reality use may cause discomfort for some people, including motion sickness, eye strain, or disorientation. Please read and follow the health and safety warnings provided by Meta with your headset. Take regular breaks and stop using the Service if you feel unwell.
We may suspend or terminate the license granted under these Terms if you breach them. You may stop using the Service at any time by uninstalling the App.
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date, and material changes take effect 30 days after we post them, except that changes we reasonably make for legal, security, or safety reasons may take effect immediately. We will take reasonable steps to bring material changes to your attention. If you do not agree to a change, you can stop using and uninstall the App before it takes effect, and changes do not apply retroactively to your prior use. If you continue using the Service after the changes take effect, you accept the updated Terms.
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to its conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence apply.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Any feedback or suggestions you send us about the Service may be used by us without restriction or obligation to you, and you waive any claim that we owe you compensation or attribution for it.
These Terms are the entire agreement between you and us regarding the Service and supersede any prior agreements on the subject. Our failure to enforce any provision is not a waiver of it. You may not assign or transfer these Terms without our prior written consent; we may assign them freely.
